Description of Products

TrakMaps provides data and software for electronic charts and topographic maps for boat, all terrain vehicle, and snowmobile owners.

Personal Use

TrakMaps products are not intended for commercial use. TrakMaps products are solely designed for personal use in accordance with the instructions, directives and warnings issued with TrakMaps products.

Prohibited Use

TrakMaps products shall not be used for any ends prohibited by these terms of use. TrakMaps products shall not be used in contravention of the laws, statutes, regulations, rules, decrees, codes, guidelines, and policies in effect in the jurisdiction within which they are used.

Limitation of Liability

Use of TrakMaps products is made by the purchaser, end user, and/or subsequent users and purchasers at their own risk. TRAKMAPS PROVIDES NO GUARANTEE THAT THE DATA USED FOR TRAKMAPS CHARTS, CHARTBOOKS, TOPOGRAPHIC MAPS OR ANY OTHER TRAKMAPS PRODUCTS ARE COMPLETE AND/OR ACCURATE. TRAKMAPS IS NOT LIABLE FOR ANY DIRECT OR INDIRECT DAMAGES CAUSED BY THE USE OR MISUSE OF THIS OR ANY OTHER TRAKMAPS PRODUCT, INCLUDING BUT NOT LIMITED TO; INDIRECT, PECUNIARY, INCIDENTAL, EXEMPLARY, AND CONSEQUENTIAL DAMAGES RESULTING FROM INACCURATE MAP DATA OR ANY OTHER DAMAGE RESULTING FROM THE USE OR MISUSE OF TRAKMAPS PRODUCTS.

Specific to Product

Marine (GPS)

This product has been produced by TRAK CONCEPT DE CARTES INC. dba TRAKMAPS based on Canadian Hydrographic Service (“CHS”) data, following any minimum standards/guidelines that may have been established by CHS, pursuant to CHS Digital Value-Added Reseller Agreement no. 2023-1206-1260-TCC-D.

The incorporation of data sourced from CHS in this product shall not be construed as constituting an endorsement by CHS of this product.

This product does not meet the requirements of the Navigation Safety Regulations, 2020 under the Canada Shipping Act, 2001. Charts and publications issued by or on the authority of CHS must be used to meet the requirements of those regulations.

Snowmobile Newfoundland (GPS)

WARNING: This file(s) contains information on snowmobiling within GMNP. The file(s) may include maps or GIS data of the snowmobile areas, or GPS track files of commonly used routes within Gros Morne National Park. These snowmobile areas or commonly used routes are neither marked nor maintained in any manner by Parks Canada. Winter conditions change frequently. It is the user's responsibility to ensure weather, snow, and ice conditions are safe for travel along these routes at all times. This information was prepared by Parks Canada using its best judgment and information available at the time of preparation. Any use you make of this information and any reliance on or decisions made based on these files are your own responsibility absolutely. Parks Canada, its employees and its agents accept no responsibility for damages, if any, suffered by you or any third party as a result of decisions made or actions based on these maps or files. For greater certainty, under no circumstances whatsoever will Parks Canada, its employees, or its agents be held liable for any loss or damage that may occur to you and any person or persons or property by reason of your or their reliance upon these track files or maps.

Except with the express written consent of TrakMaps and its licensors, the copying, transmission, distribution, modification, resale, rental or transfer of TrakMaps products is strictly prohibited.

Abuse Toward Our Staff

Abuse toward our staff will not be tolerated. Any threats, use of vulgar words or aggressive behaviour will result in refusal of support without refund, exchange, or any other sort of compensation.
